Somalia’s Judicial Institutions Seek Solutions to Alarming Prison Capacity Crisis

Major General Hassan Ali Noor Shute, Chairman of the 1st Degree Court of the Armed Forces, has brought attention to a critical issue plaguing Somalia – the severe shortage of prisons. Shute highlighted the pressing nature of this problem, emphasizing that the absence of adequate detention facilities has led to significant challenges in managing individuals arrested for various offenses.

According to Shute, the Mogadishu Central Prison has evolved into a catch-all facility for individuals involved in diverse criminal activities. This situation has transformed the prison into a crowded holding center for individuals who, ideally, should be distributed to different facilities based on the nature of their offenses.

Speaking on the matter, Lieutenant Colonel Hassan Ali Noor Shute outlined that, due to the shortage of prisons, many activities that could be prevented are allowed to persist. The prison, initially intended for a capacity of 800 people, currently houses a staggering 1,600 individuals. This overcrowding exacerbates the challenges faced by authorities in maintaining order within the prison.

Furthermore, Shute drew attention to the fact that “moral and disciplinary crimes are often addressed outside the prison setting due to these limitations.” He expressed concern over the lack of appropriate facilities to handle cases of serious offenses such as murders and acts of terrorism.

The Chairman of the 1st Degree Court stressed the gravity of the situation, highlighting the absence of designated places to detain individuals accused of severe crimes. He underscored the importance of addressing this issue promptly to ensure that perpetrators of serious crimes are appropriately held accountable.

Shute cautioned that, “without sufficient prisons, individuals arrested for various reasons may receive amnesty in the future due to the lack of proper detention facilities.”

He emphasized the urgent need to find solutions to this crisis to prevent further challenges in the country’s judicial system.
