Kenya: LSK condemns Wajir MCA murder, demands probe

Law Society of Kenya (LSK) has condemned the abduction and murder of Wajir’s Dela Ward MCA Yussuf Hussein Ahmed.

Ahmed was abducted on 13th September 2024, at around 8:00 pm along Enterprise Road in Nairobi by heavily armed individuals driving unmarked vehicles, according to a statement from his family.

Following the abduction, the family reported the incident to the Directorate of Criminal Investigations (DCI) at Makadara Police Station under OB No. 86/13/09/2024.

The LSK, acting on behalf of the family, obtained a court order on September 26, 2024, directing the Director of Public Prosecutions (DPP) and the DCI to produce Ahmed in court or explain his whereabouts if he was in custody.

However, both authorities failed to comply with the order.

Tragically, on September 27, Ahmed’s mutilated body was discovered in Lake Yahud.
The LSK has termed the killing a gross violation of fundamental human rights, including the right to life guaranteed under Article 26(1) of the Constitution of Kenya.

In a statement, LSK President Faith Odhiambo expressed outrage at the incident and called for an independent investigation into Ahmed’s murder, urging the DPP to direct the Inspector General of Police to launch urgent investigations into the case and bring the perpetrators to justice.

“We demand an immediate, thorough, and independent investigation into the abduction and murder of Yussuf Hussein Ahmed, we urge the Director of Public Prosecutions to exercise his powers under Article 157(4) of the Constitution and direct the Inspector General of Police to urgently conduct investigations aimed at apprehending and prosecuting all those involved in this heinous crime,” said Odhiambo.

The case has heightened concerns over the increasing reports of extrajudicial killings and disappearances in the country.

“The extrajudicial killing of Ahmed is an attack on the rule of law and a reminder of the urgent need for accountability in such cases,” the LSK said.

The LSK has also reiterated its commitment to pursuing justice for Ahmed’s family and ensuring that those responsible are held accountable.

Ahmed’s family and the people of Wajir County are mourning his untimely death, with leaders across the country condemning the act and calling for swift justice.
