The Assembly of States Parties of the International Criminal Court (ICC) has voted to remove prosecutor Karim Khan over sexual misconduct allegations, his legal team has confirmed, suggesting that the move was \u201cpolitical\u201d<\/p>\n
The vote on Friday came as the ICC faces backlash from the United States and Israel after Khan issued\u00a0arrest warrants\u00a0for Israeli Prime Minister Benjamin Netanyahu and his then-Defence Minister Yoav Gallant in 2024.<\/p>\n
Tayab Ali, head of Khan\u2019s legal team, noted that a judicial panel had \u201cunanimously\u201d determined that findings by the United Nations Office of Internal Oversight Services \u201cdid not establish misconduct or breach of duty by Mr Khan under the relevant legal framework\u201d.<\/p>\n
The administration of President Donald Trump had imposed sanctions on Khan and several other ICC officials and judges over the Netanyahu warrant.<\/p>\n
\u201cThe decision has grave implications beyond Mr Khan\u2019s individual case,\u201d said Ali.<\/p>\n
\u201cThe independence of the International Criminal Court depends upon its elected officials being protected from removal through processes that are political, procedurally unfair or inconsistent with the findings of independent judicial bodies.\u201d<\/p>\n
“The lawyer added that Khan was removed \u201cby an executive vote while under sanctions and while the Court is under immense political pressure\u201d.<\/p>\n
Ali added that the decision by the Assembly of States Parties \u201cdoes not follow the evidence or the findings of the only judicial determination in this matter\u201d.<\/p>\n
Member states approved Khan\u2019s dismissal almost two years after the allegations first surfaced. The 56-year-old British barrister had already stepped aside in June after an oversight panel concluded he had committed \u201cserious misconduct\u201d.<\/p>\n
The ICC said on Friday that Khan\u2019s office will now be headed by deputy prosecutors Nazhat Shameen Khan and Mame Mandiaye Niang.<\/p>\n
Mr Khan\u2019s removal was determined by a process in which he was never given a fair opportunity to be heard, and in defiance of the conclusions of the independent judges who examined the full evidential record,\u201d Ali said.<\/p>\n
Khan\u2019s accuser, named only \u2060as Sarah, recently told CNN that Khan had shown escalating behaviour of touching and groping her, recounting a time she said he touched her intimately while she was pretending to be asleep.<\/p>\n
Khan has denied any wrongdoing and his lawyers have called the process that led to the vote procedurally unfair and unsupported by evidence.<\/p>\n
Khan was leading probes into multiple conflicts, but his decision in 2024 to seek arrest warrants for Netanyahu and Gallant over war crime charges in Gaza prompted an intense backlash from governments and advocacy groups.<\/p>\n
Former European Union chief diplomat Josep Borrell wrote in an editorial that the case against Khan is \u201cobviously part of a larger offensive against the ICC\u201d.<\/p>\n
Khan\u2019s dismissal immediately triggers the election process for a new ICC prosecutor, although a vote is not expected before next \u200cyear.<\/p>\n
His removal will have no immediate impact on the arrest warrants issued in 2024\u00a0for Netanyahu\u00a0and Gallant for crimes against humanity, which can only be withdrawn by ICC judges.<\/p>\n
Still, Israeli officials have seized on the news to decry the ICC investigation.<\/p>\n
Yechiel Leiter, Israel\u2019s ambassador to the US, claimed without evidence that Khan issued arrest warrants against Israeli officials \u201cto divert attention from his sex crimes\u201d.<\/p>\n
\u201cNow, with his own scandals exposed, his corrupt case against Netanyahu and Gallant is exposed as illegitimate,\u201d Leiter wrote in a social media post.<\/p>\n
\u201cThe ICC\u2019s credibility is in the gutter. Time to close this kangaroo court\u201d.<\/p>\n
For its part, the Palestinian mission to the Hague decried attacks on the courts.<\/p>\n
\u201cThe desperate attempts by Israeli occupation representatives and apologists, linking the vote to remove the Prosecutor of the ICC to the ongoing and independent investigation in the Situation in the State of Palestine, including the arrest warrants against alleged criminal Israeli officials, committing crimes under the Court\u2019s mandate, are highly cynical,\u201d it said.<\/p>\n
The ICC said after Khan\u2019s dismissal that the prosecutor\u2019s office \u201cremains committed to conducting independent and impartial investigations and prosecutions across all situations under the Court\u2019s jurisdiction to deliver justice for victims of Rome Statute crimes\u201d.<\/p>\n
